Important legal notice

Please read these Terms carefully. By using SaferRoadsNSW (“the Service”) you agree to these Terms. If you do not agree to these Terms then you must not use the Service.

Purpose

The Service provides general information on NSW speed limits, speed cameras and speed zone management and a forum for public comment. The Service may not be relied on as evidence of a particular speed limit and you must refer to the relevant posted speed limit sign at all times.

Personal use only

The Service is intended for personal use only. You must not use it for business purposes or re-supply the information to others.

Subscribing to speed limit email updates

The Service may allow you to subscribe to email updates notifying you of changes to permanent speed limits in the region or regions you have nominated. Email updates will not cover any temporary speed limit changes managed by other authorities or changes for road works.

Unsubscribing

You can unsubscribe from the email updates at any time by the unsubscribe link in the email.

Limitation of liability

Subject to any responsibilities implied by law and which cannot be excluded, Transport for NSW is not liable to you for any losses or expenses arising out of or referable to the Service howsoever caused. Without limiting the foregoing Transport for NSW is not liable for the unavailability or non-performance of the Service or your reliance on it. Transport for NSW’s liability for breach of a condition or warranty implied by law which cannot be excluded is limited to the extent possible to the supply of the services again.

Offence to use mobile devices

You must not access the Service on any kind of device in your vehicle unless your vehicle is parked. It is illegal for a driver to use a mobile phone held in the hand, whether or not the vehicle is moving.

Changing these terms

Transport for NSW may change these Terms at any time by updating them on the SaferRoadsNSW website. You agree that by doing so Transport for NSW has given you notice. You should check the terms each time before you use the Service.

Cancellation by Transport for NSW

Transport for NSW may suspend or cancel your access to the Service in whole or part if at any time if you breach these Terms of if you do not respond to any request from Transport for NSW to update your details. Transport for NSW may also cancel or suspend the Service in whole or part at any time without notice.

General

The laws of New South Wales Australia apply to the Service and your use of it. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. If any provision of these Terms of Use is invalid under the law of any jurisdiction the provision is enforceable in that jurisdiction to the extent that it is not invalid, whether it is in severable terms or not. You may not rely on the words or conduct of Transport for NSW as a waiver of any right unless the waiver is in writing and signed by Transport for NSW. These Terms of Use as amended from time to time contain the entire agreement between you and Transport for NSW regarding your use of the Service and supersede any prior agreements between you and Transport for NSW concerning its subject matter. “Includes” and “including” are not words of limitation.


Privacy statement

Transport for NSW is collecting your personal information for the purposes of the Safer Roads NSW online service (“the Service”). Providing this information is voluntary however you will not be able to fully use all of the Service unless you do.

Where you make any submissions to Transport for NSW about a speed limit or speed limit sign, or suggest a location for a speed camera, Transport for NSW may provide your submission and your name and address to relevant third parties (e.g. local councils) in connection with your submission or inquiry. Transport for NSW may also contact you to discuss any submission or inquiry to make or to undertake a customer satisfaction survey.

Otherwise Transport for NSW will not disclose your personal information without your consent unless authorised by law.

Your personal information will be held by the Centre for Road Safety at 18 Lee Street, Chippendale, NSW 2008 and generally you can contact Transport for NSW to access or correct it.
